MyYard.Sale Site Policy

1. Age Requirement & Eligibility

You must be 18 years or older, or the age of majority in your jurisdiction, to create an account and post listings. By using this platform, you represent and warrant that you meet this requirement. You are solely responsible for ensuring your use complies with all local, state, federal, and international laws.

2. User Responsibility & Assumption of Risk

You are solely and fully responsible for:

• Your account, password, and all activity under your account
• All content you post, including listings, photos, descriptions, prices, messages, and location data
• Verifying the accuracy, legality, and appropriateness of your listings
• All interactions, communications, negotiations, and transactions with other users

You understand and agree that MyYard.Sale does not vet users, verify listings, or guarantee user behavior. You assume all risks associated with using the platform, including but not limited to: fraud, theft, personal injury, property damage, or illegal activity arising from meetups, payments, or items bought/sold.

3. Public Information Warning

Any information you post may be publicly accessible. You choose what to share. Do not post full home addresses, private phone numbers, financial details, or other sensitive information unless you accept the risk of making it public. MyYard.Sale is not responsible for your privacy choices.

4. Prohibited Content & Conduct

You may not post or transmit content that is: illegal, fraudulent, misleading, defamatory, obscene, pornographic, harassing, threatening, hateful, infringing on intellectual property or privacy rights, containing malware, or otherwise objectionable. You may not list weapons, drugs, stolen goods, counterfeit items, animals, or services prohibited by law.

We reserve the right to remove content and ban users for any reason, but we have no obligation to monitor or police content.

5. Marketplace Disclaimer - No Involvement in Transactions

MyYard.Sale provides a venue only. We are NOT a broker, agent, seller, buyer, or party to any transaction. We do not handle payments, shipping, pickup, delivery, title transfer, or disputes. All transactions are strictly between users. You release MyYard.Sale from all claims, demands, and damages related to disputes with other users.

6. DISCLAIMER OF WARRANTIES

THE SITE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OR ERROR-FREE SERVICE. WE MAKE NO WARRANTY REGARDING THE QUALITY, SAFETY, OR LEGALITY OF ITEMS LISTED, THE TRUTH OF LISTINGS, OR THE ABILITY OF SELLERS TO SELL OR BUYERS TO PAY.

7. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYYARD.SALE, ITS OWNER, AFFILIATES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM: (A) YOUR USE OR INABILITY TO USE THE SITE; (B) USER CONTENT OR CONDUCT; (C) TRANSACTIONS OR INTERACTIONS BETWEEN USERS; OR (D) UNAUTHORIZED ACCESS TO YOUR ACCOUNT. OUR TOTAL LIABILITY SHALL NOT EXCEED $100 USD OR THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS, WHICHEVER IS LESS.

8. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless MyYard.Sale and its owner from any claims, liabilities, damages, losses, and expenses, including legal fees, arising out of or related to: (a) your content, (b) your use of the site, (c) your violation of this Policy or any law, or (d) your transactions or interactions with other users. We reserve the right to assume exclusive defense of any matter subject to indemnification.

9. Release of Claims

You hereby release MyYard.Sale from all claims, demands, and damages of every kind, known and unknown, arising out of or connected to disputes between you and other users. If you are a California resident, you waive California Civil Code §1542, which says: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release..."

10. No Duty to Monitor

We have the right, but not the obligation, to monitor, edit, or remove content. We do not endorse user content and are not responsible for it.

11. Termination

We may suspend, limit, or terminate your account or access at any time, for any reason, without notice or liability.

12. Governing Law

This Policy is governed by the laws of the State of Idaho, without regard to conflict of law principles. You agree to exclusive venue in Ada County, Idaho for any disputes.
